Accounts are opened subject to status. Accounts must be operated within an agreed credit limit. All invoices must be settled within 30 days. If the customer fails to pay any invoice by the due date, interest shall become payable on all overdue amounts calculated at a daily rate equivalent to 8% per annum above the base rate of the Bank of England, and the client will be liable to reimburse to the Company all costs and expenses, including legal costs incurred in the collection of any overdue amount. All and any discounts arranged only apply to 30 day settlement. Any invoice dispute must be raised within 30 days.
Whilst every reasonable care will be taken in handling all clients’ materials, including originals supplied and unexposed film or paper accepted for processing, our liability for any loss or damage however caused, including negligence or work incorrectly carried out by CMYKimaging including our staff or agents, loss or damage in transit, delay in transit wherever the destination, loss or damage during storage of exposed film is limited to the replacement of the unexposed materials only and CMYKimaging will not be liable for any loss of income by the client or any consequential damage incurred by the clients as a result of such negligence or loss. All clients’ materials accepted by ourselves on the strictest understanding that the replacement value of all materials does not exceed the present retail price of the unexposed and unused materials, as shown in manufacturers price lists. Clients are advised that where material is of a particularly critical nature, they should insure themselves against loss or damage.
Orders are only accepted on the strictest understanding that the client has the necessary copyright and moral rights, clearance or any other necessary permission to copy, reproduce, change, manipulate, receive, transmit and store all materials supplied, and that the client automatically assumes liability for any legal action by any party that may be taken against CMYKimaging, either through breech of copyright, moral rights, other necessary permission or for any other reason.
Clients’ original negatives can be stored at our premises for one year free of charge. Thereafter they will be returned to the client unless otherwise agreed.
